Welcome to Dirt Surfer Racing (DSR), a platform designed to connect riders with media of themselves captured at racing events. By registering and using DSR, you agree to these Terms and Conditions. Please read them carefully.

2. Primary Function

The primary purpose of DSR is to allow riders to access, view, and download photos and videos of themselves from events. These downloads are intended for personal use, including social media sharing, personal collections, or promotion of the rider’s activities.

3. Account Responsibilities

• Users must provide accurate information when registering.
• Users are responsible for maintaining the confidentiality of their account credentials.
• Users must be at least 13 years old or meet local age requirements to create an account.

4. User-Generated Content

All content uploaded to DSR, including photos, videos, and event information, must be created by the user or uploaded with proper permission. Users retain copyright ownership of their content. By uploading content, users grant DSR a non-exclusive, worldwide, royalty-free license to store, display, and provide downloads of the content on the platform.

5. Copyright and Commercial Use

• The original creator of any photo retains full copyright ownership.
• Subjects depicted in photos retain rights to their likeness for personal use.
• DSR holds a license to display and provide downloads for personal use.
• Riders depicted in photos are granted full personal use rights.
• Commercial use of any photo or video by anyone other than DSR or the rider featured is strictly prohibited without prior written consent from both the creator and the subject.
• Unauthorized commercial use may result in a penalty of $10,000 USD per instance and legal action.

All images and videos are Dirt Surfer Licensed. Contact us at support@dirtsurferracing.com for permission to use content commercially.

6. Personal Use

Users may download and share content for personal, non-commercial purposes, including posting to social media or maintaining personal collections. Any use beyond personal, non-commercial purposes requires prior written permission.

7. Privacy and Data

8. User Responsibility and Conduct

Users agree not to upload content that:

• Violates any copyright, trademark, or privacy rights.

• Maintain and improve the platform’s technology, infrastructure, and features.
• Create and manage sponsorship and partnership opportunities for riders, events, and the sport.
• Market and promote the business and its services to grow the community and user base.
• Provide prizing, contests, and incentives for platform users.
• Fund operations, development, and legal compliance necessary to run the platform sustainably.

By using DSR, you acknowledge that the platform is operated as a for-profit business. Donations, sponsorships, and other contributions support the ongoing operation and growth of the platform. These contributions are used at the discretion of DSR to achieve business objectives and are not considered charitable donations.

13. Community and Roles

The Dirt Surfer Racing (DSR) community consists of various participants who contribute to, support, and engage with the platform. Each role is defined as follows:

1. Ambassadors

Ambassadors are registered users or appointed individuals who represent DSR publicly, promote the platform, encourage user engagement, and may help recruit new riders or content contributors. Ambassadors may receive special privileges or recognition but do not have ownership of the platform.

2. Subcontractors

Subcontractors are third-party individuals or companies engaged by DSR to perform services on behalf of the platform, including content management, technical support, marketing, photography, event coordination, or other specialized tasks. Subcontractors operate under agreement with DSR and are not considered owners of the platform.

3. Donations

Donations are voluntary contributions made by riders or community members to support DSR operations. Donations are used to maintain the platform, create sponsorship opportunities, market the business, and provide prizing or incentives for users. Donations are non-refundable and are not considered charitable contributions, as DSR is a for-profit organization.

4. Sponsors

Sponsors are individuals, organizations, or companies that provide financial, material, or promotional support to DSR or its events. Sponsorship may include funding contests, prizing, or platform initiatives. Sponsors do not hold ownership of the platform, and their contributions are managed at the discretion of DSR for platform-related objectives.
